Bangalore: The Karnataka High Court will on Monday resume hearing on a petition filed by five independent MLAs challenging their disqualification from the state Assembly.

The court had last week ruled that the outcome of the October 14 trust vote of the BS Yeddyurappa government would be subject to its final decision on this petition.

The High Court, which had reserved orders on the petitions filed by 11 rebel BJP MLAs, challenging their disqualification under anti-defection law by Assembly Speaker KG Bopaiah, had refused interim relief to all the 16 MLAs, who sought a stay on their disqualification.

The petition, filed by the five independent MLAs contending that they cannot be disqualified as they won the election as independents, was posted for hearing today.

They had also filed an advanced application before the court on October 13 on the eve of the Chief Minister BS Yeddyurappa seeking the second trust vote for an order to allow them to vote in person or to keep their votes in a sealed cover till the court announced its verdict, which was also rejected.

According to sources, the court is yet to set a date for delivering its verdict on the issue of disqualification of 11 BJP MLAs, over which it has reserved judgement.

It is to be seen whether the court delivers its order on both the petitions today or postpones it further.

The ruling BJP, opposition Congress and JDS have been pinning hopes on the court ruling, which has a bearing on deciding the fate of the BS Yeddyurappa ministry.

The Speaker had disqualified 16 MLAs on October 10, a day ahead of the first vote of confidence bringing down the effective strength of the 224-member Assembly to 208.

Though Yeddyurappa won the trust vote by voice vote, Governor HR Bhardwaj rejected it as a "farce" and directed him to go in for the second floor test on October 14, which the chief minister managed to win by head court by a margin of 106-100. Two MLAs -- Manappa Vajjal from BJP and MC Ashwath of JD(S) -- were absent which brought down the effective strength of the 224-member Assembly to 206.

New Delhi: After Prime Minister Manmohan Singh, UPA chairperson Sonia Gandhi on Monday attacked the Nitish Kumar government while addressing a political rally in Kishenganj in Bihar.

Kicking off her campaign in Bihar ahead of the Assembly polls, Sonia hit out at Nitish calling him an ‘opportunistic leader’. She said that the Congress has given crores of rupees to Bihar for its development, but Central funds remain unspent.

The Congress president maintained that the UPA government has not compromised over its secular policies.

Sonia also targeted Bihar’s NDA government over its employment and education policies.

Sonia’s remarks reiterated Prime Minister Manmohan Singh’s charge that Bihar was misusing central funds.

Earlier, while addressing a rally in Bihar, Dr Singh had charged that Nitish Kumar-led NDA government had failed to fully implement Centrally-sponsored schemes in Bihar but was taking credit for them.

This statement led to a war of words among the leaders of BJP and Congress.

On Sunday, Nitish had hit back at the Prime Minister while holding the Congress responsible for the ills plaguing the state.

At this Ram Lila, squabbling Ravan refuses to die

Agra: For the first time in the history of the more than 100-year-old Ram Lila on the grounds opposite Agra Fort, Ravan simply refused to die.

All hell broke loose Sunday night when the Ram Lila - a dramatic enactment of the epic Ramayana - had reached its tail end. As thousands of highly amused spectators watched, Raju, the actor playing Ravana, decided he was loving the limelight and could not leave the stage so soon.

As Ravan refused to be killed, the organising committee decided to let Ram move ahead in his chariot to torch a huge effigy of the mythical 10-headed king of Lanka.

But even as the burning Ravan effigy tottered and splattered all around, high drama continued in the middle of the ground. Raju kept wielding his sword dangerously, even scaring away Ram and the other characters.

"The free-for-all was indeed symptomatic of society at large with so many Ravans in myriad forms growing bolder by the day and refusing to meet their nemesis at the hand of the righteous," said Sudhir Gupta, who watched the Ram Lila.

The ground was divided into Ayodhya and Lanka - the two places where much of the Ramayan unfolds. Trouble started when Shyam Babu, one of the office-bearers of the Ram Lila committee, urged Raju to hurry up with Ravan's death scene.

"The character playing Ravan, with a bunch of supporters in tow, really got into the mood and kept putting up a fight with his sword. He was in no hurry to speed up his death as he enjoyed the cheer all around," said Vishal, a photographer who watched the proceedings from close.

A member of the organising committee confided that Raju, who was playing the character of Ravan, did not like the constant pressure on him from Shyam Babu to get killed soon. Shyam Babu is the owner of the Kunjamal Tent House which has been traditionally making all the arrangements for Agra's main Ram Lila for past 100 years.

Even after lots of cajoling, Ravan refused to die. He moved from the middle of the ground to Lanka and then disappeared from the scene. Informed sources later said "Ravan returned to Lanka" instead of dying as is the tradition. "The question now being debated is whether Ravan did or did not die, though his effigy was burnt," wondered Padmini, a housewife.

Raju even pulled out his sword. Shyam Babu and two others are believed to have got hurt. This was a signal for more trouble and the actors representing the two armies of Ram and Ravan got involved in a fight for a few minutes - much to the amusement of spectators.

Shyam Babu told police that Ravan and his team members were insisting that there should be at least 21 bombs in the effigy. This argument escalated and created an ugly situation, and police arrived on the scene. Raju even tried to bully a sub-inspector and other cops who eventually managed to clear the stage with much effort.

The committee members debated the issue and Sri Bhagwan Agarwal, the secretary, tried to pacify all the warring groups till midnight. "Most probably the fireworks will continue for a few days because it is a serious matter," commented Surendra Sharma, president of the Braj Mandal Heritage Conservation Society. "How can Ravan refused to get killed at the hands of Ram who represents all that is good and right in society? Or is it that a new script is being written inspired by what's going on in today's India?"

Maoists trigger landmine blast near BSF camp

Orissa: Maoists triggered a landmine blast near a BSF camp in Orissa's Naxal infested Malkangiri district this morning.

The powerful landmine was set off along a road at Sikhapalli near here apparently targeting BSF personnel who move out in groups from their camp in the morning hours, Inspector In-Charge of Malkangiri police station R K Pati said.

No one was injured as there was no movement near the site when the landmine exploded about 250 metres from thetemporary BSF camp, he said. A portion of the road was damaged in the incident.

The blast was probably aimed at thwarting a health and awareness camp which was scheduled to be held by the BSF personnel deployed in the area, police said. The proposed health camp was deferred in view of the blast. Combing operation and patrolling had been intensified in the area to track the ultras.

In another development in Gobindpalli in the district, about 50 km from here, Maoists have put up a large number of posters and banners asking special SPOs and home guards to quit their jobs, the sources said.

Ayodhya: Nirmohi Akhara to also move SC

Lucknow: The decision of the All India Muslim Personal Law Board (AIMPLB) to take the Ayodhya battle to the Supreme Court has prompted one of the key Hindu parties, Nirmohi Akhara, to follow suit, almost ruling out any chance of an out-of-court settlement.

"We have no choice but to move the Supreme Court now, since the Sunni Central Waqf Board's resolve to file an appeal agaist the (Sep 30) Allahabad High Court verdict has been formally endorsed by the Muslim Personal Law Board," Akhara spokesman Mahant Ram Das told IANS over telephone from Ayodhya.

Speaking on behalf of 89-year-old Akhara head Mahant Bhaskar Das, who avoids talking over the phone on account of his hearing impairment, Ram Das said: "We were somehow apprehensive that a particular lobby among Muslims was not interested in closing the Ayodhya chapter and that is exactly what has happened. Under the circumstances, we are compelled to take the same course and file an appeal before the Supreme Court."

Asked what would happen to the initiatives taken by 90-year-old Hashim Ansari, the first Muslim plaintiff in the case, to put an end to the court battle and settle the dispute through dialogue, Ram Das said: "Well, we all appreciate Ansari's efforts to which Mahant Bhaskar Das had also responded very positively, but what to do now?"

Signalling a hardened position, he said: "We have reason to believe that we must not only have full right over the entire disputed land, but also be given complete right to perform puja and have full control over the proposed temple."

A three-judge special bench of the Allahabad High Court had ordered division of the disputed 90 ft x 120 ft plot of land where the Babri masjid once stood into three parts - one to Ram Lalla, one to the Nirmohi Akhara and one to the Sunni Waqf Board.

After a meeting of its executive here Saturday, the AIMPLB said it had decided to appeal in the Supreme Court against the Ayodhya verdict, but clarified it was not opposed to an out-of-court compromise, though with certain conditions.

Asked to comment on the change in Nirmohi Akhara's stand, All India Akhara Parishad chief Mahant Gyan Das blamed it on Bhartiya Janata Party (BJP) vice president Vinay Katiyar.

"It is all because of Vinay Katiyar that the Nirmohi Akhara has altered its stand. It appears that Katiyar has poisoned the mind of Mahant Bhaskar Das," he said.

Gyan Das, who strongly championed keeping politicians out of the amicable settlement process, alleged Katiyar had vested interests.

"Having been a MP from the area in the past, Katiyar knows that he could continue to get political mileage out of the issue only as long as it was allowed to simmer," he said, referring to Katiyar's stint as Faizabad MP.

Earlier this week, Katiyar told mediapersons in Ayodhya that no out-of-court settlement on the issue was possible until Muslims abdicated their claim even to the one-third portion of the disputed site.

New Delhi: After Prime Minister Manmohan Singh, UPA chairperson Sonia Gandhi on Monday attacked the Nitish Kumar government while addressing a political rally in Kishenganj in Bihar.

Kicking off her campaign in Bihar ahead of the Assembly polls, Sonia hit out at Nitish calling him an ‘opportunistic leader’. She said that the Congress has given crores of rupees to Bihar for its development, but Central funds remain unspent.

The Congress president maintained that the UPA government has not compromised over its secular policies.

Sonia also targeted Bihar’s NDA government over its employment and education policies.

Sonia’s remarks reiterated Prime Minister Manmohan Singh’s charge that Bihar was misusing central funds.

Earlier, while addressing a rally in Bihar, Dr Singh had charged that Nitish Kumar-led NDA government had failed to fully implement Centrally-sponsored schemes in Bihar but was taking credit for them.

This statement led to a war of words among the leaders of BJP and Congress.

On Sunday, Nitish had hit back at the Prime Minister while holding the Congress responsible for the ills plaguing the state.

Dhaka, Delhi erect fences on border

Dhaka: Bangladesh and India have begun setting up fences within 150 yards of the zero line along the international border.

The exercise, which is on for some months now, marks a deviation from the Indo-Bangladesh Boundary Agreement 1974 that restricts any construction within 150 yards of the zero line.

"It is essentially addressing the needs of both too," The Daily Star newspaper said Monday and added that the move marked "thawing of thorny border ties".

Bangladesh has allowed India to erect fences at a dozen new places and India recently began construction. In return, India allowed Bangladesh to construct structures within 150 yards of the zero line at 11 points.

The initiative came from India early last year. It had been seeking to erect such fences within 150 yards of the zero line at 46 places.

Bangladesh's border guard chief, Maj.Gen. Rafiqul Islam, told the newspaper Sunday: "As we have agreed to the Indian proposal, India is also reciprocating by allowing Bangladesh to construct a bridge in Laxmipur, expansion of a wall in Hili, construction of approach roads in Moulvibazar and Bhomra, and several other initiatives."

"Our mutual agreement has created a very positive environment. Both countries are now willing to resolve long standing minor issues," he said. The border fencing by India to prevent smuggling of humans, cattle, drugs and arms has been a prickly issue in bilateral relations.

The official said India had been allowed to carry out fencing after surveys had been conducted. "We are continuing such surveys to see if accepting the Indian proposal will affect Bangladesh adversely in anyway," the official said.

He made it clear that both countries are constructing the structures within their own boundaries.

India has so far fenced 3,300 km of the border beyond the 150 yard zone within its own territory in line with the boundary agreement.

Pak PM Yousuf Raza Gilani rules out clash with judiciary

Islamabad: Pakistan's Prime Minister Yousuf Raza Gilani on Sunday ruled out any clash between the executive and the judiciary even as he issued a veiled riposte to the detractors of his government, saying there should be mutual respect among state institutions.

Gilani's remarks, made in the course of a televised address to the nation, came against the backdrop of a suo moto case initiated by the Supreme Court following media reports that the government was planning to sack some members of the superior judiciary.

The apex court took up the case even after Gilani denied the media reports.

The premier said there was no chance of a clash between the various institutions of the state as his government believes in a policy of reconciliation and would stick to this path.

"The policy of reconciliation will bring political powers and state institutions closer, with the welfare of the people being the focal point," he said.

"If we can work together with the army and create consensus among political forces, then we can certainly go along with the judiciary," he said.

At the same time, Gilani made it clear that remarks by him and President Asif Ali Zardari denying any move to sack judges of the apex court should be accepted by all.

When such assertions are not accepted, "then I may remind that we are violating the principles of mutual respect, which is the soul of the constitution", he said.

"If false news is given preference over the words of the Prime Minister, then it would be an insult to the stature of the Prime Minister," he remarked.

Despite the government's denials, the apex court has asked the government to submit a statement signed by the Prime Minister explaining its stance on the issue of the alleged sacking of judges by tomorrow.

Gilani said he had ordered an inquiry into the media reports that caused the furore so that the people could find out who was behind the move to spoil relations between the judiciary and the executive.

In a show of strength, Gilani was flanked by Chief Ministers of Balochistan, Khyber- Pakhtunkhwa and Gilgit Baltistan and senior Ministers of Punjab and Sindh when he delivered the address.

The Chief Minister of Punjab, which is ruled by the opposition PML-N, was conspicuous by his absence.

Pak feels let down by US over its mere lip-service but little action

Islamabad: With the third round of the US-Pak strategic dialogue all set to take place in Washington next week, Pakistani authorities are getting irritated over the lack of US interest in resolving the country’s long-term regional issues, providing economic support, and appreciating its sacrifices, despite publicly declaring it a key ally in the war on terror.

The authorities are also dissatisfied with the ‘triple accounting’ by the US of its economic assistance to Pakistan, although the overall assistance remained less than 1.5 billion dollars in a year, the Dawn reported.

Another reason for their anger is that Pakistan has not been given market access for its products they believe it deserves in comparison to other countries.

“Since our engagement with US after 9/11 about more than nine years ago, the United States has made wide-ranging trading arrangements with Latin American countries, African nations and even some states in the Middle East but greater market access to Pakistan still remains far off,” a government official pointed out.

Officials said that these were some of the issues, which the Pakistani delegation led by Army Chief Ashfaq Parvez Kayani would raise again with the US authorities during the forthcoming strategic dialogue.

“The US actions and assurances do not match when it comes to Pakistan’s role and returns it should get,” an official said.

According to him, in background discussions, the US leadership never missed an opportunity to assure Islamabad how central they considered a stable Pakistan to achieve global and regional peace, but they looked the other way when the government discussed the US’ role in resolving a ‘proxy water war launched by India’ besides the longstanding Kashmir issue that was the key to regional stability, and controversial river projects.

They revealed that these irritants had repeatedly been discussed with Secretary of State Hillary Clinton and President Obama’s special envoy Richard Holbrooke, but without any tangible progress beyond the diplomatic pleasantries.

They said that the US cooperation with Pakistan for extending market access and resolving the energy sector problems had also remained limited to lip service. Rather it opposed the Iran-Pakistan Gas Pipeline, which was key to Islamabad’s energy sector needs over the next couple of decades.

Islamabad: Pakistan Prime Minister Yusuf Raza Gilani today said Kashmir issue is part of the national agenda of the country which "can never forget it."

Gilani also claimed that the world community has strated recognising Kashmir as a disputed territory due to the efforts by his government. "Kashmir is part of our national agenda and we can never forget it. The Kashmiri people live in our hearts. We inherited this love from our late leader (President Zulfiqar Ali) Bhutto," Gilani said in an address to the nation that focussed largely on domestic political issues.

"Today, the world community has for the first time begun recognising Kashmir as a disputed territory due to our efforts. It is a big success for us that the European parliament has agreed to a tripartite dialogue on the Kashmir issue. Kashmir was represented in this by the Prime Minister of Azad Jammu and Kashmir," he said.

The European parliament accepted Pakistan's view that the UN and the Organisation of the Islamic Conference should be made part of efforts to find a solution to the Kashmir issue, he said.

The "prime minister" of Pakistan-occupied Kashmir, Sardar Attique Ahmed Khan, recently participated in a series of meetings on the Kashmir issue in Brussels. Reports suggested that some European parliamentarians had accepted Khan’s proposal that the European Union should coordinate efforts to find a solution to the Kashmir issue.

N-weapon hasn't enhanced India's security: Aiyar

New York: Testing nuclear weapon has not enhanced India's national security, veteran diplomat and Congress leader Mani Shankar Aiyar has said, noting that Pakistan also acquired the atomic bomb within three weeks after the Pokhran II.

"We had a strong conventional military advantage over Pakistan....the minute we became a nuclear weapon power....it took Pakistan three weeks to become a nuclear weapons power themselves," Aiyar said, who is at the United Nations to speak on the issue of nuclear disarmament.

On the necessity of having nuclear bombs since Pakistan had them, Aiyar told PTI that that India's security hadn't been enhanced by acquiring these weapons.

He said India always remained in the vanguard of the movement for nuclear disarmament but lost its traditional position on the issue in the past 22 years as it had to conform to the voices of other nuclear powers, the Congress leader said.

"Even since we have become a nuclear weapon power ourselves ... there seems to be a certain ambiguity as to how pro-active we should be in regard to nuclear disarmament," Aiyar told agency.

"India always remained in the vanguard of the movement for the elimination of nuclear weapons?it is a position we have tended to lose the past 22 years," he continued.

"We should strive and pro-actively to our traditional position."

Aiyar further pointed out that India was being held back in pursuing its "traditional position" since now it had to conform to the voices of other nuclear powers, which was not the case in 1982 when Prime Minister Rajiv Gandhi laid down the Action Plan for a Nuclear-Weapons- Free and Nonviolent World Order.

The Action Plan sets 2010 as the date by which the world would have been rid of nuclear weapons, and that is reason Aiyar decided to speak at the UN on that forgotten deadline set 22 years ago.

"Having become a nuclear weapon power there is a desire that our postures in regard to the international discussions on nuclear weapons should be more in conformity with the nuclear weapons powers than asymmetrical to that position," Aiyar said.

"I have continued to take an interest in this matter, which is disproportionate to the interest that the government of India is taking at the moment," he added.

Responding to whether the new US-Russia agreement to cut down their nuclear arsenal would move the world towards fuller disarmament, Aiyar said "It?s good but it's not disarmament."

"It is the reduction of hostility between the two powers who share between them perhaps 90 per cent of the entire nuclear arsenal of the world," he added.

"It is a reflection of the reduction of the danger of nuclear war breaking out between these two major powers."
